  • Note: Under AS 39.52.210, a public employee who is involved in a matter that may result in a violation of AS 39.52.110 - 39.52.190 shall refrain from taking any official action relating to the matter and immediately disclose the matter in writing to the designated ethics supervisor. 

    Under AS 39.52.220, a board or commission member must disclose a potential violation of AS 39.52.110 - 39.52.190. If the chair, as designated ethics supervisor, or a majority of the board or commission, not including the subject member, determines that a violation will exist if the member continues to participate, the member shall refrain from voting, deliberating, or participating in the matter. 

    Under AS 39.52.230, any person may report a potential violation of AS 39.52.110 - 39.52.190 to a public officer's designated ethics supervisor, who shall make a determination as provided in AS 39.52.210 or 39.52.220.

    A copy of this disclosure and the ethics supervisor's determination must be submitted to the attorney general with the next quarterly report.

  • Note: Under AS 39.52.310(b), any person may file a complaint with the attorney general regarding the conduct of a current or former public officer whom the person alleges has violated the Ethics Act. A complaint must be in writing, be signed under oath, and contain a clear statement of the details of the alleged violation.
